Welcome to Nanny & Me (“App”), provided by Nanny & Me (“we”, “us”, “our”). These Terms govern your access to and use of the App and the accompanying website located at nanny-me.com (“Website”). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

Eligibility & Accounts

You must be 18 years or older, or have the consent of a parent or legal guardian, to use the App. Certain features may require creating an account using a valid email address. You are responsible for maintaining the confidentiality of your log-in credentials and for all activity under your account.

App Store Terms

The App is distributed via Apple’s App Store. Your use of the App must comply with the App Store Terms of Service. Apple is not responsible for providing maintenance or support for the App, nor for any claims arising from its use. To the maximum extent permitted by law, Apple has no warranty obligations with respect to the App.

Subscriptions & Payments

• Certain features are available through an auto-renewing subscription purchased via your Apple ID.
• Payment will be charged to your Apple ID at confirmation of purchase.
• Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
• You can manage or cancel your subscription in your Apple ID account settings.
• No refunds are provided for partial subscription periods except where required by law.

Use of the App

• You may log baby-related information, manage multiple child profiles, set reminders, review reports, and share data with caregivers as available.
• You agree not to misuse the App, reverse engineer it, or use it in a manner that violates any laws, regulations, or these Terms.
• We reserve the right to modify, suspend, or discontinue any feature at any time with or without notice.

Data & Privacy

Our Privacy Policy describes how we handle personal data. By using the App, you acknowledge that your information will be processed as described in that policy. Website analytics only load after you allow analytics on the Website.

Content & Intellectual Property

The App and Website, including all content, design, text, graphics, logos, and software, are owned by Nanny & Me or our licensors and are protected by intellectual property laws. You are granted a limited, non-transferable license to use the App for personal, non-commercial purposes.

User Content

You retain ownership of your data entered into the App. You grant us a limited license to process that data for the purpose of operating and improving the App. You are responsible for ensuring that any information you share with caregivers or third parties is shared lawfully.

Third-Party Services

The App may rely on third-party services such as Apple, Supabase, RevenueCat, and PostHog. We are not responsible for the content, policies, or practices of third parties. Links to third-party sites are provided for convenience.

Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the App will be error-free, uninterrupted, or that it will meet your specific needs. The App is not a medical device and does not provide medical advice; always consult qualified professionals.

Limitation of Liability

To the maximum extent permitted by law, Nanny & Me will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to your use of the App. Our total liability for any claim arising under these Terms is limited to the amount you paid for the App or subscription in the 12 months preceding the claim.

Indemnity

You agree to indemnify and hold Nanny & Me, its directors, employees, and licensors harmless from any claims arising from your misuse of the App or violation of these Terms.

Termination

We may suspend or terminate your access to the App at any time if you breach these Terms or if we discontinue the App. Upon termination, the rights granted to you under these Terms will cease immediately.

Governing Law

These Terms are governed by the laws of the Republic of South Africa, without regard to its conflict of law principles. If you are a consumer in another jurisdiction, you may also have rights under your local laws.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, if required, notify you via the App or email. Continued use of the App after changes become effective constitutes acceptance of the updated Terms.
